Preamble
Welcome to Campcruisers GmbH! We are delighted that you have chosen Campsite OS. Our goal is to make your daily work as a campsite operator as simple and efficient as possible. With our cloud-based Property Management System (PMS) and ERP solution, we aim to provide you with complete digital management of your business — from the first booking through check-in to the final billing — all from a single source.
These General Terms and Conditions (GTC) form the fair and transparent legal basis for our collaboration. They are formulated to provide legal certainty for both you and us without getting lost in unnecessary bureaucracy. A respectful, partnership-based interaction at eye level is our top priority. If you have any questions about these conditions, our features, or your subscription, please do not hesitate to contact us. Our support team is happy to assist you with all concerns.

§ 1 Scope and Definitions
1.1 Scope
These GTC apply to all contracts between Campcruisers GmbH and its customers concerning the use of Campsite OS. Our offering is exclusively directed at entrepreneurs within the meaning of § 14 BGB (B2B). Contract conclusion with consumers (§ 13 BGB) is excluded.
1.2 Deviating Conditions
Deviating GTC of the customer become part of the contract only if we have expressly agreed to their validity in writing.
1.3 Definitions
“SaaS” (Software as a Service) refers to the provision of our software solution via the Internet.
§ 2 Contract Conclusion
2.1
The presentation on our website does not constitute a binding offer (invitatio ad offerendum).
2.2
The contract is concluded by order confirmation via email.
2.3
We store the contract text and send you the order data via email.
2.4
The 14-day trial phase does not automatically convert into a paid subscription.
§ 3 Service Description
3.1
Campsite OS is a cloud-based PMS and ERP. The scope of functions depends on the selected plan (Easy, Professional, Supreme).
3.2
We continuously develop Campsite OS and reserve the right to make changes, provided the purpose of the contract is not jeopardised.
3.3
System availability: 99% annual average (SLA).
§ 4 Prices and Payment Terms
4.1
All prices include VAT. Billing monthly or annually in advance.
4.2
Payment via Stripe: credit card, Apple Pay, Google Pay.
4.3
Invoices in PDF/ZUGFeRD format. Payment term: 14 days.
4.4
In case of default: 9 percentage points above the base interest rate + 40 EUR reminder fee (§ 288 para. 5 BGB).
§ 5 Service Provision
Provision as SaaS via the Internet. Access data after contract conclusion via email.
§ 6 Retention of Title
For physical goods, we retain ownership until full payment is made.
§ 7 Warranty
Warranty period: 24 months. Commercial duty to inspect and notify defects according to § 377 HGB. Subsequent performance through bug fixes or updates.
§ 8 Limitation of Liability
Unlimited liability in cases of intent, gross negligence, and personal injury. In cases of slight negligence: maximum annual fee. Indirect damages excluded. Data loss: only in case of missing own backup.
§ 9 Set-off
Set-off only with legally established or undisputed counterclaims.
§ 10 Right of Withdrawal
No right of withdrawal, as this is a B2B offering (§ 14 BGB).
§ 11 Software Use and Contract Term
11.1
Simple, non-transferable right of use for internal business purposes.
11.2
Reverse engineering and scraping prohibited.
11.3
Minimum term: 1 month (or 12 months annually). Termination period: 1 day. Automatic extension.
11.4
Termination button available in the customer account.
11.5
After termination: 30 days data retention (Retain 30), then irrevocable deletion.
11.6
Updates included. First response time support: 24 hours.
§ 12 Confidentiality
Both parties treat confidential information strictly confidentially. This also applies after the end of the contract.
§ 13 Force Majeure
No liability in cases of force majeure. Performance obligations are suspended for the duration of the impediment.
§ 14 Digital Services Act (DSA)
14.1
We provide technical infrastructure. Accommodation contract between you and end customers.
14.2
Tiered cancellation model configurable in the dashboard.
14.3
Reporting form for illegal content. Response time: 72 hours.
§ 15 Data Protection
Processing in accordance with GDPR, BDSG, TDDDG. Data processing agreement pursuant to Art. 28 GDPR provided upon contract conclusion.
§ 16 Dispute Resolution
Internal complaint management. EU dispute resolution: https://ec.europa.eu/consumers/odr/. No participation in consumer dispute resolution (B2B).
§ 17 Final Provisions
17.1
Severability clause.
17.2
Changes to GTC via email. Objection period: 4 weeks.
17.3
Assignment permitted.
17.4
Contract language: German (decisive in case of translations).
17.5
Applicable law: Germany, excluding UN Sales Law (CISG).
17.6
Place of jurisdiction: Falkensee.
